When we here at the Atlanta, Georgia Accident Law Firm first ran this post, it more of a news item than a legal analysis of any sorts. That was because it was news and people were searching for information on the topic. And given that actual people are involved I decided at that time not to do any legal coverage of the event because it seemed tacky to be talking about that when other people in their family were attending funerals. Now, it have been many months, and no one is searching for that on this site anymore. Therefore, I have decided to go back and do an update of the news event in Georgia and provide legal coverage of how this should have played out with their personal injury attorney.
The old post started as: This is a post from the McDonough Personal Injury Law Firm of Joseph P. McClelland.
It is a sad day in Georgia. Two children died in a car accident today on the way to school in Rockdale County, Georgia. The driver of the car was a high school senior and his little sister. The young boy was 18 years old. His name was Karl Michael Anschutz. She was only 14 years old. Her name was Laura Anschutz. The young boy was on the way to Heritage High School, and she was on the way to Davis Middle School.
It is believed that while on the way to school their car must have crossed the yellow line. As the car crossed the yellow line, a truck was coming from the opposite direction. It is believed the young boy swerved back into lane, went off the road, and then over-corrected. This made is car go back into the lane of oncoming traffic. The driver of the truck, was a male, and was injured. He was taken to the hospital and later released. It is unknown the extent of his injuries.
I wish the family of these children my condolences. The family must be going through a lot. If you know this family send them your love and prayers.
Now, I did put in a little amount of what we do here below, but that is necessary to some degree to keep all of the topics on point in a search engine sort of way.
The Law Office of Joseph P. McClelland handles car accidents, auto accidents, tractor trailer accidents, car wrecks, biking injuries, pedestrian injuries and other negligence cases in McDonough, Henry County; Jackson, Butts County; Griffin personal injury, Spalding County; and Monticello, Jasper County, Georgia. You can see that I chose some of the smaller cities around Georgia at the time.
Now, let’s look at what will happen from an insurance settlement point of view when someone dies in a Georgia car accident. In this case, the facts were really too early to determine who was at fault. From the way I wrote the article it seems that the kids were at fault. In that circumstance, the driver of the truck would have the claim. He would bring a claim against the insurance company of the kids which was most likely the parents’ insurance. That driver would also seek to stack any other insurance policies of anyone who lives at the same home as the boy.
Had the boy just ran off the road or did something similar and no hit the driver of the truck, the young girl could bring a Georgia wrongful death claim against the parents’ insurance. Why? What did she do negligently? Nothing, and she suffered. Therefore, she could sue the insurance company that covered the car they were in. She could sue the insurance company for additional policies the parents have, and any uninsured motorist coverage policies that are available. With a wrongful death case, the average settlement for a minor is well over one million dollars, so the parents will likely be under insured for that amount. Most people do not carry one million dollars in auto insurance. Although, if they had an umbrella policy rider, they might have enough insurance.
Well, that was the update. I hope you learned something and come back for more information on auto accident laws.
While you were here may I said propose a post on the Georgia accident reports. An accident report is supplied to all parties involved in a vehicle crash. The report features data about the car owners, the insurance policy companies, a detailed description of what brought about the mishap, plus whether or not any specific citations were presented. The facts included in these kinds of reports ought to be included in a great demand letter to the insurance company for the settlement of your case. If you are fascinated with crash articles, then I must advise this contribution. In this post we have listed 10 car crash articles that we feel are interesting to those who have been in an accident. Many of those articles involved fatal car accidents and deadly automobile injuries. Many of these tend to be for enjoyment purposes rather than educational functions. One of my favorite articles in this list is about how to draft the best letter to the insurance companies. This particular subsequent one is fantastic. It goes into remarkable degree about each of the objects that are necessary for a vehicle accident demand letter in Georgia. As a possible attorney I feel it is important to educate individuals about insurance policy matters.
