Here is some recent news in Henry County from your McDonough Personal Injury Lawyer.  On Friday March 2010, a women was crossing Jonesboro road and was hit by a driver of a Black SUV.  The driver got out of the car and spoke to the injured pedestrian.  However, and contrary to Georgia Car Accident Laws, got back in her vehicle and took off.  One thing happen, though, the driver did not expect.   That is part of the accident was caught on the dashboard camera of a police officer.

The driver appears to be liable for any and all damages for the pedestrian.  The injured person can recover lost wages, pain and suffering, medical and hospital bills, and damages for future medical bills and suffering.  Also, in a situation like this, punitive damages might be available.

I hate hit-and-run drivers for several reasons.  First reason is that they cause an accident.  The second reason is because they left the scene of the accident without giving their information so that insurance claim can be filed.  The biggest reason I do not like hit-and-run drivers is because it makes it very difficult to complete a personal injury claim.

Since the driver cannot be found, it is impossible to file a claim against your insurance company.  Since we do not know who they are.  That leaves us in a very bad situation.  Our only alternative is to look to the insurance policy of the driver that was actually get in to see if there are any additional policies that might be applicable in this situation.

First of all, I would look for any medical payment insurance in your policy.  This would allow us to compensate medical professionals to give you treatment so that your injuries will eventually heal otherwise if you do not have insurance it will be extremely difficult to get you the proper medical treatment.

The next thing we would need to look for is the availability of any uninsured motorist coverage insurance.  This would allow us to file a claim with your own insurance company because the driver that hit you.  Since they cannot be found are technically uninsured.  In this situation we would treat the claim as any other claim in order to get you your maximum car accident settlement.  This is another example of why it is important to have both medical payment insurance and uninsured motorist coverage on your current automobile insurance policy.
