Recently in Atlanta another terrible car accident has taken the life of a young man. This is a legal post from the Atlanta Injury Lawyer, Joseph P. McClelland. This basics that form this article are from recent news organizations.
Governor Purdue’s office has lost a former intern. Jordan Griner was that intern who lost his life due to a drunk driver in Atlanta.
The person responsible for the accident is Christa Scott. She is only 26 years old. The recent reports has her leaving work drunk. The police indicate that her blood alcohol level was 0.229. The legal limit is 0.08. So, she was very, very drunk when she left work.
This raises a potential issue of dramshop liability. That is when someone else severed her alcohol when they knew that she was going to drive. Since she was leaving work, I can assume that someone behind the bar kept serving her beer or whatever. This would bring the bar into a potential lawsuit. Although, if she were the bartender and served herself, it is very possible that the bar would avoid liability.
She, on the only hand, is liable criminally and civilly for the accident and resulting death. As for her, the first place of recover would be to look towards her car insurance policy. Further, since she was drunk, the insurance company may very well be liable for punitive damages in the case.
Back the news story. Christa Scott was released on bond on Monday night around ten o’clock. She was charged with first-degree vehicular homicide, DUI and reckless driving. It is very likely she will serve some time followed by a long probation period.
Normally, bonds will be given if the defense attorney can show to the court the defendant is not a flight risk, has ties to the community, and other pertinent facts. Therefore, the defense attorney was able to show the Judge these factors were in favor of the defendant.
The Judge probably doesn’t like these types of cases. No one likes to have everyone looking over their shoulder, but in a case like this, that is just the situation. If this kid doesn’t show up for the next hearing, the district attorney will request a forfeiture of the bond money and an issuance of warrant.
Most likely since the defendant is a kid, the parents put up the bond, and will make sure the kid shows up to court on time.
