Negligent Hiring and Retention – Georgia Accident Lawyer – McClelland Law Firm

Negligent Hiring and Retention is a serious topic.  If you were hurt by an employee of a business, you may have additional claims that you are not aware of.  As a Georgia Accident Attorney, I understand that the standard of care in a negligent hiring or retention lawsuit is if the employer knew or should have known the employee was not suited for the particular employment.  See Kemp v. Rouse-Atlanta, Inc., 207 Ga. App. 876(1), 429 S.E.2d 274 (1993).
This does not mean that the employee has a criminal background, and the boss failed to check it out.  Of course, if [...]

Many times with an injury and almost all times with a serious injury you will miss work.  Your income will fall.  You will have less money.  You might [...]

Georgia Dog Bites

My Doggie

Dog Bites in Georgia
I love dogs.  I really do, but some dogs are dangerous.   Most are not and are completely lovable.  My family growing up treated dogs as members of the family, and we all still do.  However, being attacked by a vicious dog can cause sever injuries or even death.  Young children are especially susceptible for various reasons.  For one, they can be fearless.  The other reason is that they just don’t know better yet.  In fact, according to the Centers for Disease Control and Prevention, 4.7 million Americans are bitten by dogs every year.  And of those, [...]

Victory – Unemployment Appeal

The Georgia Personal Injury Lawyer and Georgia Auto Accident Lawyer has some news.  Victory for a client who was wrongfully denied unemployment insurance.  The government employer claimed the employee was fired for not following the state policy.
We successfully argued that the state policy in question was never consistently applied.  Our research uncovered five or six employees who were not terminated for higher alleged offenses.
Based upon these facts, the earlier decision was overturned and the client will get his back payments and payments into the future.

Florida’s former congressman, Alan Grayson, was in a car accident today.  A Florida lawyer himself, Mr. Grayson will likely have an insurance claim on his hands.

The accident was caused by the former congressman.  According to reports, Mr. Alan Grayson ran a red light and hit a public bus.  He was driving his Mercedes Benz at the time of the accident.

Conspiracy to Commit Felony or Injury Lawsuit? Saints’ NFL Bounty Scandal

Impeachment

Update of the story that has been in the news of late about the bounty placed on opposing teams’ players.  The story is quite interesting and infuriating at the same time.
It is being reported that the New Orleans Saints were up to no good.  Now, this is football, so there is a sliding scale here.  But, the story is pretty juicy.  Allegedly, the Saints were paying players to go out and try to injure certain players.  I guess that scandal is the paying part.  Their job is to hit people really hard, so the controversy is the money part.
Between $1000 and $1500 [...]

LegalZoom.com Dumps Rush with Form Documents

Legalzoom

Sometimes I wonder why let the world surprise me.  I just learned that Rush Limbaugh, the famous right-wing talkshow host, has just been dropped by one of his major sponsors.  There’s only one thing that hurts a person like Rush Limbaugh, and that is money.  No matter what you say to a person like Rush Limbaugh or Sean Hannity, the only thing they hear is the cash register ringing with money.
How are these guys paid?   The answer is with revenue from ads and sponsors.  This is where the recent announcement by LegalZoom.com that they are dropping could all Rush Limbaugh [...]

Montana Federal Judge: Racist or Lover of Bestiality?

Justice is blind.  Criminals go to jail.  The good guys win over bad guys.  Judges hold honest trials.  People tell the truth. Judges don’t tell racist and bestiality jokes.  Of all of those statements, do any seem to be correct to you?
Federal judge Richard Cebull has done the absolute thinkable for an idiot (I am assuming his is an idiot out of politeness for the word racist is likely more accurate).  The Montana federal judge has forwarded an email that is showing just who he is and the kind of honest man he is.
Let us talk about judges and integrity in the [...]

Newt Arrests Judges on Moon Colony

newt-judges-you

Image via Flickr Being an attorney, I am always amazed at the level people stoop to hate my profession. Georgia politician took that hatred to a new level when he recommended that legal decisions have no impact if he doesn’t like them. Further, he continued that judges should be put in jail for making bad [...]

Black While Jaywalking

Supreme Court Retires

A new crime is blowing up the press for the last few months: Black While Jaywalking and it’s first victim is Racquel Nelson.  Before we talk about the judge’s refusal to drop the vehicular homicide charge against a jaywalker, let’s address the elephant in the room.
You may have heard the term BWD which means black while driving.  This is used to refer to the crime of being a black man in a car on a road.  Obviously, that is not a crime, but the main reason why The new term BWJ, I just made up because it makes sense.  Why am I talking [...]

Interstate 20 Accident Attorney

If you have ever been on I-20, then you will understand the capacity for wrecks.  Entering Atlanta you must go through the Interstate 285 entrance and exit ramps.  Then, you must cross over the connector of Interstate 75 and Interstate 85.
Atlanta has terrible traffic problems, and I-20 plays right into that.
