The purpose of a personal injury claim is to put the injured in the same place they were before the negligence of the other.  This includes pain and suffering.  This makes sense.  Before the accident you were not in pain. After the accident you were in pain.  To get back to square one, we have to deal with the pain you suffered.  It does not matter if the pain you suffered lasted one day or your entire life, you have a right to compensation for that injury.

For example, let us say that you were rear-ended on interstate 75.  You suffered from whiplash and a sore knee.  The knee stopped hurting later that day, but the whiplash did not stop for some period of time.

You went to the emergency room, but days later you were still not feeling better.  You went to your primary care doctor, then a chiropractor.  Later, you went to a orthopedic doctor.  You experienced pain.  Should tort reform require you to only accept the price of your medical bills, and give you no money for your pain and suffering?  No.

Under Georgia law, the measure of damages for pain and suffering is the enlightened conscience of impartial jurors, is also correct. Betts Co. v. Hancock, 139 Ga. 198 (6) (77 SE 77). The fears of a pregnant woman that the injury received by her may affect her child are compensable under this rule. Pullman Co. v. Strang, 35 Ga. App. 59 (132 SE 399).
