Uninsured Motorist Coverage in a Georiga Motorcycle Accident

Hello, this is your Georgia motorcycle accident lawyer. Today’s article will be about the importance of having uninsured motorist coverage when involved in a Georgia motorcycle accident. As a Georgia motorcycle accident attorney, I understand that the likelihood of a serious injury after a motorcycle wreck is extremely high.  The reasons are quite obvious, such as not having airbags, not being encased in a steel chassis, and only having a helmet to protect you.  Because of this, it is extremely important to fully understand your insurance policies and to make sure that you have the best and correct insurance in case of such an accident.

Now, everyone knows that you are required to have automobile coverage to protect the other driver in case of an accident that is your fault.  Most people do have the minimum amount of insurance which in Georgia is $25,000 per person with a maximum of $50,000 per accident.  Now, that might sound like a lot of insurance coverage, but in reality that is very little especially when you are involved in any motorcycle accident in Georgia.

Do You Need Uninsured Motorist Coverage in a Motorcycle Accident?

The purpose of this article is to ensure a motorcycle drivers have additional insurance other than the minimum requirement.  I am specifically talking about the need to have uninsured motorist coverage on your policy.  So, let me explain what uninsured motorist coverage is.  This is insurance that will provide you coverage if the other driver is one uninsured or two under in short.  The second point of that is extremely important because most people do not understand.  If the driver has no insurance at all, then your uninsured motorist coverage or UM coverage will provide insurance.  If the other driver had insurance that your injuries exceed the amount of their available coverage, then you now must look to your own policies to find additional money. This is when we turn to your policy in Georgia.

However, I’m about to notify you of a ripoff alert. A scam if you will. The way that will cause you to spend money and gets you half to the way there were a few more bucks would’ve gotten you all the way there. I am talking about UE coverage.  This is uninsured motorist coverage, without doubt.  The issue comes down to how all the money is proportioned.  This will be easier to look at if we use an example.

How Does Uninsured Motorist Coverage in a Motorcycle Accident Work?

Let’s say that you have a Georgia motorcycle claim and your damages are worth exactly $50,000.  In our first example is the driver that hit you does not have any insurance, but you have $25,000 in uninsured motorist coverage.  In this example, you would be able to utilize the full $25,000 of your uninsured motorist policy.  However, if you noticed you did not get enough money to fully compensate you.

In the second example, the driver that hit you carries the minimum amount of insurance which is $25,000, and you still have $25,000 in uninsured motorist coverage.  Do you get $25,000 or do you get $50,000? This is where the scam alert comes into play.  If you have traditional uninsured motorist coverage and it is not described as uninsured excess or UE coverage your $25,000 will not go to you.  You will be left only with $25,000 which came from the other driver. Even though you paid money for UM coverage, you have the wrong UM coverage.  If you have found this to be the case I would place a very angry phone call to your insurance agent because you got screwed.

Now, let’s look at a third example.  In this case, the other driver has $25,000 and you still out $25,000 in UM coverage, however this coverage is UE coverage.  In this case you will get the $25,000 from the first driver and you will get the $25,000 from your uninsured motorist policy.  This is because of the excess label.  That means that the first $25,000 of your money is not going to feel the first hole, but rather you get to add it together to get full compensation.  So in this case your damages were $50,000 and there is exactly $50,000 in insurance coverage for you.  Which one of the scenarios would you prefer? If you are a motorcycle driver, it is imperative for you to look at your insurance policy and make sure that you have uninsured motorist coverage.  Then, you must make sure that your uninsured motorist coverage is in excess of the damages.  Look for the letters UE.  If you do not see them, I would contact your insurance agent immediately before you are in an accident and need that coverage.
