1.  Start a fight with your spouse.  What is the best kind?  How about a dagger in back?  How about some name calling?  The best time to get someone to not sign paperwork is right when they are about to sign it.

2.  Want something you can replace.  You really want the bed, trust me…and the 18 inch black and white TV.  Dig in your heels.  Turn this divorce into a contested one and let the judge decide who gets the microwave.

3.  Be inflexible.  Be insufferable.  You know what they really want, so don’t let them have it.  There was a time in the past when you loved this person.  No one is asking you to get back together at this point, but something simpler.  Just be nice.  It will save you a great deal of time and money with your Atlanta divorce lawyer.

One reason that you might have to file a car accident lawsuit in Georgia is because of the failure to come to an agreeable settlement. The insurance company thinks they know the value of the case to them. It is based upon their experience handling similar claims and how similar claims have been handled in the jurisdiction in which the case would be tried if it had to go to court. On the other hand your Georgia personal injury lawyer has their own view on the value of your case, as do you. It is the job of the attorney and it is the job of the insurance representative, both which represent their own respective clients, to come up with a proper settlement.

This requires flexibility and patience. It also requires a true understanding of the value the case. If either participant in negotiations is outside of the acceptable range of settlements, then it is based upon one of two things. The first being that someone wishes to be litigious and to not settle the case or because each party has placed a different value upon the same facts.

I’m assuming here of course that both parties have agreed to the facts of the case. If a case has dispute liability, such as were not exactly sure who was at fault for how much at fault, then the value each party puts on the case could be wildly different.

For example, the insurance company does not think that there driver was at fault and we think that there driver was at fault. The insurance company would and should in that case offer is $0.00. On the other hand, we will expect full compensation for all of your injuries and expenses. In this situation, you can clearly see that both parties will have difficulty in coming to an agreement in regards to selling the case without being flexible and without having the patience to wait for the other side to become flexible.

The deciding to file a personal injury lawsuit does require a certain amount of forethought. You cannot rush into these things. There are certain considerations that you should be aware of before you make the determination to abandon settlement negotiations and to proceed towards litigation.  For example, say you were in a motorcycle accident. A suit against a county has a different timeline than a suit against an individual. Your Georgia motorcycle accident attorney knows this, and will keep you protected.

One obvious factor in determining whether to file suit are not is the statue limitations. The schedule notations is a legal deadline which must be met in order for the case to remain valid. If a lawsuit is filed after the statue limitations, then your case will be thrown out of court and you will have no recovery. So, obviously knowing the statute limitations for each type the defendant is of utmost importance in the determination to stop attempting to settle the case in the file suit.

Another consideration is the whimsical nature of the American public. There is never a guarantee that you’re going to win trial. Each jury is comprised of 12 individuals. And those individuals are completely different. They may see your case completely different we but how we view. They may believe the other driver is to blame for the accident, but days don’t want to give you the amount of money that we are requesting. There could be numerous reasons why the jury returns a smaller verdict than desired.

For one we always want more than we should get. But seriously, everyone views what happens to them with more importance than what happens to someone else. It is our job and responsibility during the trial to make sure that the jury understands how the accident affected your life. The pain and suffering that you went through is important detail. How that pain changed your daily base your daily lifestyle. How that change affected those around you.  In it is a case-by-case basis obviously.

Someone with a minor injury will not look will not be looked at the same way as someone with a more severe injury. And to some degree the injury is more severe than the average person is accustomed to seeing, then the verdict may be equal to or greater than what we actually hoped the jury would return. That is on the good side. But on the bad side, they could not like you is individual. They could find that you are untrustworthy. They could find that the medical providers did not do a good job. They could find the other driver is just so sweet and they don’t want to give a verdict against them.

But I do know the the insurance company will provide a certain amount coverage for the other driver, however that is not something that we are allowed to introduce a trial. What that means is the jury when they go to deliberate the case must know coming into it is that the person that hired the attorney representing that poor old lady hit you is being paid for by the insurance company. And that same insurance company has millions of dollars to pay claims with. And the amount of insurance that sweet old lady has will be the amount the insurance company will pay anything above that amount that sweet old lady will be responsible for. So on one hand, that sweet old lady has a million-dollar I brought policy, but the jury thinks that she has a $25,000 minimum insurance policy, we may have a problem.

That is another reason why going to trial may not always benefit each client individually. I have had clients that had tattoos on her neck that you could see. That is not client you want to try without a turtleneck on. I personally don’t have any tattoos, but to each his own. However, not every juror or person lives their life as such. That is an extreme example, however it is important to note that each little factor can adjust the amount of the verdict. The main take away here is that trials are unpredictable in the amount of the insurance offer is fixed.

Another factor to consider when thinking about taking the case to trial is the amount of additional time that it will take. Going to trial is not an easy thing. Each County has its own internal system operating. One county may be fast where another County is extremely slow. In some counties there is a tremendous backlog in the other counties not so much so. The metro Atlanta counties are quite full. What that means is time Ing spent without your money. A dollar today is worth more than a dollar tomorrow. And with that in mind you have to think about how long it’s going to take you to actually get your money. If the car insurance company were to make an offer and we accept that offer, then usually we would have a check in hand within a week or so.

Another issue is the amount of time to try a case in court versus settlement of the same personal injury cases.  If we determined that that offer was not going to cut it, and the insurance company indicated that that was the highest offer they could make without going to trial then we would need to factor that in. The difference between a couple weeks or week or so and go on trial maybe a year plus. That is important to keep in mind because you have your own life. Before your involved in this accident you had your own things going on, and had a daily routine. Now that you’re in this accident, one of the things that you’re constantly thinking about is your personal injury case. You’re probably wondering what your attorney is doing or what the other insurance company is offering or whether nine you’re going to take an offer or would you going to do with the money from the settlement are any of the above. So there is some benefit to actually resolving the case. Your mind will be able to resort to your old way of thinking which is not thinking about a car accident case. That does have some value. It especially has value if you have already healed because this will be the last scar that needs to go away.

Another thing most people don’t consider about taking a car accident case to trial is that all the details may become public. Your friends, family, strangers, and enemies will all know exactly what happened and how much money you got. To some people that is completely irrelevant. To some people that is a frightening idea. To most people it is somewhere in between. Now, unless you are in a very small town most people never know the there was a trial, but you are involved in a trial, and that you one a good bit of money. Most people do not read the legal journals to see who’s doing what in the legal community and what are the most recent verdicts. Therefore, privacy is generally not an issue and a motorcycle accident or trucking accident case. However, as a Georgia wrongful death lawyer, I understand having the world know the amount of money that you received may be frightening. If it is a substantial amount or if it is a against a high-profile defendant, then the likelihood of others knowing about your settlement is quite high.

Another detail that is important to understand about the decision where the weather to settle or to litigate a car accident case, is the attorney’s fee. Most attorneys including yours truly, works on a contingency basis which is one third of the total settlement. However if the case goes to trial, then obviously the attorneys fees will be higher. In that case most attorneys instead of charging 33% will charge 40% if not 50%. That means that right off the bat you have to do marginally better at trial than you would at the settlement for you as the client to even break even pass a decision not this except the offer from the insurance company.

Should You Hire An Attorney For a Georgia Motorcycle Accident?

As a Motorcycle Accident Attorney in Atlanta, I hear this question a good deal from people.  I also see this question in forums and such places.  It is an easy answer.  That answer is yes.  If the attorney is willing to take the time and take the case, then it must be profitable for the attorney to take your case.  In that situation, the lawyer feels that one, you have a case, and two, that your case has some value to it.

Now, you may ask the question, why not do it yourself? I hear this question all the time from one of my best friends, in fact.  I always try to answer the question like this.  Remember, so and so?  Remember how he always picked on people.  He will say yes.  Then, I ask would he pick on someone with an older brother.  And he will respond yes, unless he was there.  And then, I say exactly.  Unless someone is there to back up your threat of calling in help, you are in trouble.

The same goes with the insurance company.  You may have a good point about your brother being able to win, but not unless he is there.  With the insurance company, unless you have an attorney, why should they take you seriously?  Your big brother is not here to protect.  Untill he comes, you are helpless.  And guess what?  There is a time limit.  So, eventually, you have to call your brother before the clock runs out.  Because when that happens your case is over.

Should You Hire An Attorney For a Motorcycle Accident?

So, should you hire an Atlanta, Georgia personal injury attorney or do you have to contact an Atlanta, Georgia personal injury attorney is really the same question.  Can you see that?  Why would they ever make you a good offer?  Think about that.  You cannot take them to court.  You cannot make a good opening statement.  You cannot even answer their discovery questions and motions without losing the case.  They will try and succeed at beating you.  It is only fair and just that someone with training beats someone with the same training.  Their attorneys have trained.  Their claims adjustor has trained.  You are just you trying to get back to your old life.

I am not saying that after training you cannot do it.  I am not saying that it is beyond your capacity.  I am just saying or questioning why you would want to spend all of that time learning what to do.  Then, trying to do it for the first time.  It is too much to ask of yourself, I think.

Furthermore, the money an attorney can save you medical bills will shock you.  Have you seen your medical bills recently?  They are not cheap.  There are things that you have never heard of that cost more money that some of the best things in anyone’s house.  I hope you enjoyed all those services because they have to be paid.  You also want to be sure that when you pay them, they can never come back and ask for more money.

Motorcycle Accidents and Uninsured Motorist Coverage

Let’s transition to money why don’t we?  Insurance is the next question.  Who has it and how much?  Let’s start with the girl driver who was at-fault for the wreck.  Her insurance will be directly liable.  In Georgia, the minimum insurance requirement is 25,000 dollars per person and 50,000 dollars per occurrence.  You should be thinking that $25,000 is not enough for a broken leg, and you would be right.  We need to find more insurance.

Now, we will turn to any other policies that the young girl might be covered under.  Perhaps she is married.  If she is married and living with the spouse, then if he has an insurance policy on a car that insurance policy may provide coverage.

Pause.  If husband does have additional policies, it is important to see if his policy has a different policy number than his wife’s.  If it is the same policy number with two different schedules of coverage, then it is the same as just having one.

Now that we have seen if she has additional coverage, we turn to the young man’s policies.  Since he is a young man (and invincible) he will not likely have uninsured motorist coverage.  At this point the insurance hunt may be over.  But wait!  Does the young man still live at home.  Let us assume that the young man was hit in Macon, but lives with his divorced father in Atlanta.  His father has uninsured motorist coverage on his Honda Civic, but the son is not listed on the policy.

In Georgia, the son would be able to utilize the uninsured motorist coverage policy from his dad.  This would allow him additional coverage.

Let’s go even further and assume the father has uninsured motorist coverage on three other autos all with separate policy numbers.  In this case, young man with the broken leg would stack all of the insurance policies to cover his damages.

Likely damages would start to mount up quickly.  Ambulance, doctor’s bills, emergency room bills, imaging bills, surgery, physical therapy, and others are just the start.  We should not forget about his pain and suffering, potential for permanent disability, lost wages and more.

As soon as this kid was hit on his motorcycle, I am sure the other insurance company was quick to contact him and offer him a quick settlement.  They probably even “disclosed” the amount of insurance and told them that they would try to get it to cover all of the losses, but it is what it is.  Do you really think they told the kid about the possibility of husband’s insurance?  Do you really think they told him about uninsured motorist coverage?  Do you think they tried to tell him not to hire a lawyer?  Can you figure out why or should you read the article again.  Thank you for reading Atlanta Man Hurt on Motorcycle in Macon.

What do you do in a hit and run accident?

The at-fault driver took off. You were not able to get their tag number. You looked for witness, but could not find any.  You have a damaged car and medical bills. Does that sound like the situation you are in?

As a personal injury lawyer, I know that hit and run accidents are the worst kind. Some stranger has changed your life and didn’t even stick around.  Is there a way to get your car repaired, get a rental car while your car is being fixed, pay for your medical bills and provide pain and suffering?

So, let’s get back to the heart of the matter. The first thing you should do is call the police and make an accident report. If you are injured, go seek medical treatment. Even without health insurance, any emergency room is required under federal law,  to give medical treatment if you were in an accident.

OK, now about insurance settlements?

This is where things can get tricky.  The next thing to do after the accident report and emergency medical treatment is to contact an accident attorney immediately.  Why?  Because you are in a very precarious situation.  Most likely the driver that took off will not be found unless there are witnesses with valuable information.  This may be more likely the case in a small town.

I was in a car accident in midtown Atlanta a few weeks ago.  We were hit from the passenger’s side.  I remember looking up and seeing a young girl ask me if we were alright.  I looked to the passenger in our car, and we were fine.  I, then asked her if she was alright.  She looked confused and said that she was not in the accident.  I looked at her car, and there was no damage.  She said the other driver backed up and drove off down a one way street.  We never saw her leave.  There were witnesses, but none got her tag information.  This raised an issue for my friend and his new car.

Property Damage in a Hit and Run Accident: Gap Coverage

An experienced insurance attorney will go through your car insurance policy and detail each available policy provision to be utilized.  It would benefit you well to have gap insurance in your car policy if you have a newer vehicle and owe money to a financing company or auto dealership.

Back to the issue at hand which is what to do when the other driver got away. I hope you are sitting down for this one. If you do not have uninsured motorist coverage, you will have no recovery at all. But, why? The other driver fled the scene so he and his insurance company are unknown. That means that you can’t sue who you don’t know. Therefore, we must look to your uninsured motorist coverage for settlements.

So, can you even settle a case with your own insurance company?  Yes, you can.  You paid for the car insurance for this exact reason if you bought uninsured motorist coverage.

But will it be more difficult?  Yes, in my experience these cases are slightly more difficult.  These types of cases are nearly impossible, in my earnest opinion, to try to handle them on your own.  You will blow it and make it ten times more difficult for your Atlanta personal injury lawyer or Decatur accident lawyer or McDonough accident attorney or whoever you hire in whatever city you hire them in.

But, if you find a site that lays things out for your, then you might have a lawyer that will discuss your case with you in real terms.  They will not try to snow you and up sell you on the front end, and undersells you as the case moves forward.  Honesty works both ways and is the cornerstone of a good attorney-client relationship.

As an Atlanta, Georgia Car Accident Lawyer, I thought I had seen it all.  Just when you thought it was safe to go to the liquor store, you find out it is not.  This is a post is about local personal injury news from around town.

Now, if you live in the city near Midtown Atlanta or Virginia Highlands, you are familiar with the liquor store at 737 Ponce de Leon Avenue called Green’s.  Well, have you seen it lately?  Noticed some boarded up windows?  Now, don’t start worrying that they have closed down in this terrible economy.  That is not the case.

The situation is much different.  We all know that lightning does not strike in the same place twice, but how about a car accident?  Well, it turns out that it does.  For the SECOND time, Constance Chapman drove her car through the window at Green’s Package Store.  Just think about that, for the second time she drove her car into a building.  For the second time, she drove her car into the same building.  For the second time, she drove her car through same liquor store.  Is there a connection?  Gee, one has to wonder who would have such bad luck that their brakes would fail twice at the same place while buying booze.

Did I mention that she is 75 years old?  Also, a worker at the store suffered a brain injury from a bottle falling on her head.  From a legal standpoint, Ms. Chapman’s insurance company will be writing a check very soon for their full policy amount. So, for all of you over on Ponce De Leon Avenue, Highland Avenue, Virginia Avenue, and Moreland/Briarcliff can still go in, but do so on foot.

April 22, 2010: Atlanta Motorcycle Accident News:

I saw the aftermath of a motorcycle accident  in Atlanta.  The motorcycle accident happened on Ponce De Leon in Atlanta, Georgia.  The motorcycle driver was not the scene when I arrived.  Three Atlanta policemen were there with their blue lights and they directed traffic for those driving south on Briarcliff turning into Moreland Avenue.  The motorcycle was still lying on the ground.  Most likely an investigator was arriving on the scene to investigate the causes of the accident.

Motorcycle accidents can be deadly accidents.  It is simple to say, but there is nothing there to stop you from getting hurt and protecting you from severe damage to your health.  Sure, you have you motorcycle helmet, but that is not enough to stave off injury.  A helmet will reduce the risk of a head injury, concussion, or mild traumatic brain injury, closed head injury or open head injury.  However, you head, even in a helmet, is still liable to hit the ground or another vehicle at great force.  And, of course, you body is completely exposed.  If a car hits you from the side, will like break or fracture your leg/femur/ankle/foot.  If you are hit from behind on you bike, you will likely get knocked off your bike completely.  If you are hit head-on, serious injury and death are high probabilities.  Bikes are quite dangerous.  I will say that usually motorcycles are safer in the city or on city roads because people drive slower and must pay closer attention.  On the other hand, a driver in the city has a lot of distractions coming there way.  Many people are lost, and many are on their cell phones.  In the city smaller accidents are more likely.
