Just when you thought the 2012 election season couldn’t get any stranger, it just did.  A lawsuit has just been filed in the U.S. Northern District Court in Atlanta, Georgia by attorney Joseph P. McClelland against Mitt Romney and the Mormon Church of Ladder Day Saints.

Attorney McClelland has filed a complaint on behalf of his client, Mr. Goldberg, a Jewish rabbi who lived in Dade County, Florida, before moving to Atlanta, Georgia shortly before his death, several weeks before the most recent Hanukkah.  That in of itself is no news story, but what happens next has just made Newt Gingrich the likely nominee.

Mitt Romney Admitting to Baptizing the Dead

As many people know, the Mormon Church often goes about baptizing people that are dead…and are not Mormons.  Yes, you heard that right.  Want to get baptized as a Mormon?  It is easy.  Just die.  Mitt Romney will make sure to tithe enough money to have someone come over to your grave and go all Mormon on your dead ass.

Recent photographs given to attorney McClelland reveal Mr. Romney sneaking into the Greenwood Cemetery (Jewish Section).  The photos, as described by the Goldberg’s attorney, also contain Mitt conducting the baptism himself.

The Goldberg family was not happy when they found out what had happened to their father, a Rabbi.  The family was outraged.  The family, with members across the southeast, contacted attorney Joseph P. McClelland.  With the help of a skilled litigator, justice was going to be had.

The legal complaint against Mitt Romney includes charges of  intentional infliction of emotional distress and the desecration of body. The damages sought are 3.7 million dollars.

Mr. Mokotoff, an expert on the subject of Mormons baptizing Jewish people, explained that the practice “shows incredible insensitivity to the anguish of living relatives of these martyrs, some of whom saw their loved ones murdered. . . .  Baptism is a Christian ceremony that is particularly repugnant to Jews. It reminds us of the centuries of persecution against Jews where our ancestors were given a choice: be baptized or suffer death.”

“She couldn’t understand how anyone can take a man who was a religious Jew all his life, and who was murdered for being a Jew, and baptise him. To my knowledge, once somebody’s been baptised, there’s no way to get the church to unbaptise him.”

“At present, this practice is known to only a few Jewish-American genealogists who noticed the entries in the International Genealogical Index. Once the Jewish world community is aware of the practice, it will seriously strain relations between Mormons and Jews.”

Did you know that Mormon Church members have baptized Buddha, various Popes, 9/11 hijackers, William Shakespeare, Joan of Arc, Elvis Presley, President Obama’s mother and Holocust survivors?  Add to that list Mr. Goldberg.

Okay, well, I do have somewhat of a biased opinion since I am a personal injury attorney, but let me get to the point.  Should you or do you need a personal injury attorney?.  Now, since I am an injury attorney, then the answer is probably going to me yes.

Now, it’s really impossible for me to delve into the issues of of whether not you need attorney for car accident right off the top my head.

Do You Really Need A Lawyer For A GA Personal Injury Claim?

Some things that will always require an attorney:

• you sustained any substantial damage to yourself.  So, is any personal injuries are of significant nature, then these car accidents will always require a personal injury attorney.
• You missed substantial work.
• Your life is not the same because of permanent or long lasting disability or pain.

The reason why is that the insurance companies not going to value the extent of your injuries based upon the fact that others have come before you and have done things that maybe they should not have done so the the stakes are higher.

It is important for you to build prove your case at each element along the way.  Now, the biggest reason in my opinion why you need an attorney, generally speaking, for persons your case is the fact that these guys are serious and they play hardball.  So, it’s like for them is like taking candy from a baby.  It’s like someone picking on your younger brother until you show up.  Now, I’m your older brother in this circumstance, and the reason I say that is because they can continue to give you offers of nothing.  Zero pennies until the day statue limitations is going to pass.

The Tweet Timeline & Terrible Tweeting

On Twitter users are limited to 140 characters to get there point across.  Some people a great amount of thought into their tweets, but others just run at the mouth.  This is where the problem arises.  The person that tweets instead of just saying stupid things will put those tweets into the “public record”.  The who, what, when, where each tweet raises questions with potentially troubling answers.   This is the origin of something I coined called the “Tweet Timeline”.  This is when you use the time of the tweets to place someone’s location.  In a divorce case, this could be used to show that a client was at home or out with a mysterious  lover.  In a car accident case, it could be used by an attorney to show the driver was tweeting and that tweet caused the car accident.  But, in general, using Twitter causes much fewer issues that the “Home Wrecker”.

Digg For Divorce & Reddit Before My Kid’s Standard Visitation

These are social bookmarking sites where users vote up and down other’s work.  You are safer here in my opinion, but not completely.  For example, you think your marriage is going great only to find your spouse is bookmarking divorce articles and divorce attorneys in the local market.  Yikes.  Let’s hope it is for a friend.  But, you can see the types of questions that could be raised with the content you are bookmarking.  So, that article you bookmarked about Scarlett Joannson and whats his name just got your wife nervous.

Legal Wrap Up

As a Motorcycle Accident Attorney in Atlanta, I hear this question a good deal from people.  I also see this question in forums and such places.  It is an easy answer.  That answer is yes.  If the attorney is willing to take the time and take the case, then it must be profitable for the attorney to take your case.  In that situation, the lawyer feels that one, you have a case, and two, that your case has some value to it.

Now, you may ask the question, why not do it yourself? I hear this question all the time from one of my best friends, in fact.  I always try to answer the question like this.  Remember, so and so?  Remember how he always picked on people.  He will say yes.  Then, I ask would he pick on someone with an older brother.  And he will respond yes, unless he was there.  And then, I say exactly.  Unless someone is there to back up your threat of calling in help, you are in trouble.

The same goes with the insurance company.  You may have a good point about your brother being able to win, but not unless he is there.  With the insurance company, unless you have an attorney, why should they take you seriously?  Your big brother is not here to protect.  Untill he comes, you are helpless.  And guess what?  There is a time limit.  So, eventually, you have to call your brother before the clock runs out.  Because when that happens your case is over.

Now every case has a different value. Some cases are small and some cases a big. And it is an art not a science settling  personal injury cases that involves a back injury.

How old are you? Was there a child involved? Was there an elderly or an older person involved? Was there any type of contributed negligence by you? What I mean is that were you speeding or doing something that a jury would find that you in some way or and somehow participated or caused the accident? Was it possible or you for you to completely avoid the accident?

Extent of Injury Changes Settlement

Now, let’s get back to the extent of the injury. Now I’m assuming that you received medical attention. And doctors are not for free. Therefore, I’m assuming that you’ve undergone a series of medical treatments and have corresponding bills. Now, those bills have to be paid. Now it is our job to get the other driver’s insurance company to pay those bills ultimately with a settlement or by taking the insurance company to court in order to obtain a verdict to pay those bills. Now, you’re still asking how much is my back injury case worth in Georgia.

I can only respond to questions about back injury settlements by initially asking more questions. One of the biggest questions would be are you well. And what I mean by that is are you going to require future medical bills. That is very important consideration in any back injury settlement negotiations. For example, if you’re going to require back surgery, then we must factor that in to the negotiations. In most type of cases that require surgery, I find it is best to wait until we all have a clear understanding that you’re going to be completely well when the surgery is over. Otherwise, we may undervalue your case. Many times one surgery will not be enough. In addition to the surgery, you most likely will have to endure physical therapy for several months. And even after that is over, you still may need additional surgeries are various types of adjustments. In any and all of the above scenarios, you’re going to require additional money to pay those bills. In addition to the bills, you have continued to sustain additional pain and suffering. Pain and suffering is a vital component of any personal injury settlement in Georgia.

Permanent Back Injury Settlements

Another thing to consider, is whether you will ever fully heal. Many times after an accident, you will be left disabled. Depending on the severity of injury will determine your disability rating. Knowing this information is vital to settling any back injury case.

Now we’re talking about back injury settlements, many times there is a dispute to the value of the actual case between us and the insurance company. It’s important to understand the insurance companies locate cases in more of an aggregate than on a case-by-case basis. What I mean by the insurance company settling cases in the aggregate is that there is a range of value to any case once the specific injuries and medical treatments and personality traits are analyzed.

Now based upon the range the insurance company will offer a back injury settlement, and obviously on the lower end of that range. Now, each individual case is different however, they will on occasions risk of high verdict at trial because they know that they will statistically receive a low verdict for a similar case at a different trial. They play the odds. But that is their business model, because every day they can hold your money is the day there earning interest on your money.

Without knowing all the information to the above questions, it would be a complete disservice to you to guess what the average back settlement would be for someone in your particular situation. I don’t want to complicate this conversation but if the other driver has $25,000 in insurance coverage and we could all agree that the value of your case was $50,000, what would your back injury settlement as the plaintiff will be if you had uninsured motorist coverage in the amount $25,000?

The answer depends if you had standard uninsured motorist coverage or access uninsured motorist coverage, so be sure to talk with your attorneys or lawyers. With standard uninsured motorist coverage you will only receive $0.00 from your insurance policy. If you have uninsured motorist coverage that is in excess of the other drivers insurance, then you would be able to received an additional $25,000 on top of the other drivers $25,000 in insurance coverage. Can you see the importance of paying just a few extra dollars a month to get what could in turn be a healthy settlement.
