There is a lot of information out there, and it is difficult to get it all in one place. Even this law site has grown to over 100 pages making it difficult to find important information. The following is a list of important links for Stockbridge and McDonough personal injury insurance claims and litigation. Thanks for visiting the Atlanta Car Accident Lawyer.

Stockbridge Information Page: Find some good general information and other links regarding personal injury and car accident insurance claims.

McDonough Personal Injury Lawyer: This is the flagship of Henry County personal injury claims. A great deal of information is found here with links to many of the pages listed below. We have tried to interlink the pages for user value. We hope you find what you need.

McDonough Lawyer: Page about Henry County accidents, personal injuries, wrongful death, and a little family law.

Multiple Car Accidents

Wrongful Death Cases in Henry County: This page has information on what to do if a loved one was killed because of someone else in Henry County or if you or they live in Henry County

Tractor Trailer Wrecks: With interstate 75 going through Henry County, you know who gets hurt the most. The one with the smallest vehicle.

Interstate 75 Accidents: Everyday they happen. Driver fatigue, drug use, not paying attention, cell phone use, and even more reasons why people get into these types of collisions. With the increased speed, so is an increased danger of serious outcomes.

Don’t forget some of the old favorite of our site:

Tractor Trailer Accidents: Our flagship page for 18 wheeler wrecks in Georgia. You will find valuable information here to help you pick a law firm and know how to proceed.

Motorcycle Accidents: Given the fact that their are no airbags, seat belts, or anything but a helmet, these accidents create some of the most serious injuries. Working quickly and identifying all of the possible insurance policies is a must. If time gets between you and your claim, you may be out money. You might even need to call a bankruptcy firm to get you out of debt.

Car Accidents: The old tried and true. The information here is similar to motorcycle and tractor trailer accidents. You must contact an attorney because the insurance is working full speed with their adjusters and lawyers to keep you from getting anywhere near a fair settlement.

Drunk Driving Accidents: These are the worst because the other party saw the dangers and did not care about your health. The accident could have been the result of drinking alcohol, smoking pot, doing cocaine, or other drugs. These drugs impair the driver’s ability to operate the vehicle in a safe manner. If the other driver was intoxicated, it adds significant value to your case. It also opens up the possibility of a punitive damages lawsuit.

Wrongful Death Cases: On this page you will find information on what to do if a loved one was killed because of someone else. The laws in Georgia are very strict and operate by statute. This page will go over some of the information needed to follow and how to pick a wrongful death lawyer in Georgia.

Hello, everyone from the Georgia car accident lawyer. I just wanted to say a few words after the Easter Holiday. I hope everyone had a safe and happy holiday. Please check out our new personal injury landing page for Stockbridge Personal Injury Lawyer. I will be updating the page as I go along making it more and more informative about car accidents and personal injury law in Stockbridge, Georgia. If you have been a victim in car accident and have suffered injuries and medical bills, then you should contact my office today for a free consultation. We work on contingency, so if you don’t get paid, then we don’t get paid. I hope you enjoy the site for the Stockbridge Personal Injury Lawyer for Car Accidents. Thank you.

First, will the insurance company pay my medical bills? The general answer is yes, if they find their driver was at-fault and medical bills are reasonably related to the accident. Second, will my credit be hurt? Maybe. The insurance company will only write one check at the end when all is over. In the end, all will be paid, but until then, expect calls. You can pay them yourself if you are worried, and let us get you repaid for it. Always discuss this option with your legal representative. Third, you are wondering if your car will be fixed? Yes, with the same answer as above. They treat car damage as a different type of claim and will get you a check fast for this. Usually, we let the insurance company discuss the property damage with you, and preclude them from discussing any other aspect of the case with you. You are also wondering what your case is worth. That is a case by case discussion that I would love to have with you.

Let us help you get back to living your life. In the time it took you to read this article, you could have called us and felt better about your situation. We handle these cases everyday. We negotiate with insurance companies on a daily basis. We know what they need to strike the right deal, and we know what you deserve based upon the extent of the injuries, the length of time to heal, the type and length of treatments, future and current diagnosis, lost wages, property damages, the other driver’s actions, and more. You could attempt to become an expert for one case in your life, but even attorneys say that only a fool would represent himself. And that is what attorneys says about attorneys representing themselves. You need distance. You must disconnect. You must not be emotional and not take things personally, but how can you not when it is all about you.

Representing clients in Stockbridge, McDonough, Jackson, Griffin, Decatur, Atlanta and all of Georgia.

Is the other driver, the one who actually hit your car or you or have some other personal injury, going to pay the medical bills? This is one of the first questions that comes out of the mouths of my clients on the first meeting. As a personal injury lawyer, that is a good question. As you now know, ambulance bill, doctor’s bills, hospital bills, therapy bills, and bills you didn’t even know existed start arriving in the mail. So, is the insurance company going to pay the bills? The answer is yes. But, the next question is when. So, when? At the time of settlement, usually. Or trial, if they force our hand by not offering a reasonable settlement for your injuries.

If you have been injured in a car accident, contact our office. The insurance company may want you to think they are going to pay your bills, and will tell you so. But the truth is, they will attempt not pay them. Further, they will get you to close sign away your rights for future treatment and medical costs.

The police officer describes the women driving the SUV as a white woman. She is in her 20′s with blond hair. Her hair is curly and goes to the shoulder. Henry County police are still looking for the women who hit someone with her car.

The driver appears to be liable for any and all damages for the pedestrian. The injured person can recover lost wages, pain and suffering, medical and hospital bills, and damages for future medical bills and suffering. Also, in a situation like this, punitive damages might be available.

This is a post from the McDonough Personal Injury Law Firm of Joseph P. McClelland.

It is a sad day in Georgia. Two children died in a car accident today on the way to school in Rockdale County, Georgia. The driver of the car was a high school senior and his little sister. The young boy was 18 years old. His name was Karl Michael Anschutz. She was only 14 years old. Her name was Laura Anschutz. The young boy was on the way to Heritage High School, and she was on the way to Davis Middle School.

It is believed that while on the way to school their car must have crossed the yellow line. As the car crossed the yellow line, a truck was coming from the opposite direction. It is believed the young boy swerved back into lane, went off the road, and then over-corrected. This made is car go back into the lane of oncoming traffic. The driver of the truck, was a male, and was injured. He was taken to the hospital and later released. It is unknown the extent of his injuries.

I wish the family of these children my condolences. The family must be going through a lot. If you know this family send them your love and prayers.

McClelland handles car accidents, auto accidents, tractor trailer accidents, car wrecks, biking injuries, pedestrian injuries and other negligence cases in McDonough, Henry County; Jackson, Butts County; Griffin, Spalding County; and Monticello, Jasper County, Georgia.

This is big news for claimants and personal injury lawyers in Georgia and Decatur accident victims. The Georgia Supreme Court just ruled that the cap on noneconomic punitive damages are unconstitutional.

The Court held that the Constitution guarantees a right to a jury trial. The concept is that what the jury determines is how we administer justice. (Back in the day, the plaintiff and defendant will have fight, and who won must have been right because, it was believed that the God’s hand would strike the fatal blow.)

The ruling was based on a medical malpractice case that returned a verdict of punitive damages in excess of the $250,000 punitive damages cap. The case went through the court system to the Georgia Supreme Court. The Court reasoned that if the legislature could come up the number $250,000, then why could they not come up with the number $1 or $10,000. This was important to the Court that the jury make the determination. The Court reasoned that ”the law clearly nullifies the jury’s findings of fact regarding damages and thereby undermines the jury’s basic function,” Chief Justice Hunstein wrote.

The fact that the law permits full recovery of noneconomic damages up to the “significant amount” of $350,000 is not sufficient to make it constitutional. If the Legislature may cap awards at $350,000, then it could also cap the recovery at some other figure, “perhaps $50,000, or $1,000, or even $1,” the court said.

“The very existence of the caps, in any amount, is violative of the right to trial by jury,” the decision states.

The other side failed to persuasively argue that allowing a judge to reduce a jury ward is substantially the same thing. The Court disagreed, holding that the judge’s use is limited and the “judicial remittitur is a carefully circumscribed power, the exercise of which is authorized only in the limited circumstance.”

The ruling is to be applied retroactively. This is a huge thing for all claimants and plaintiff’s attorneys.

The Law Office of Joseph P. McClelland handles all types of personal injury cases such as car accidents, premises liability, worker’s compensation, intentional torts and general negligence. Contact my office at 770-775-0938.
