The Idaho Fair Credit Reporting Act is a law that is an add-on to the federal Fair Credit Reporting Act ("FCRA") which requires creditors, also known as furnishers, and the crediting reporting agencies or CRAs maintain the accuracy of consumer credit reports and files.

The Idaho law does not add any additional penalties for violating this law unlike other states. But, under the federal law, you are entitled to emotional distress damages, economic damages, costs, and attorney fees.

What does the Fair Credit Reporting Act Protect Consumers from?

The FCRA protects consumers from inaccurate credit reporting that causes damages and does this by providing a private right of action, which means the right to sue, if creditors and the CRAs don't comply.

What are the things we advise consumers to be on the lookout for is when collection companies claim that you owe money that you've already paid off. What ends up happening is they sell that long to another collection company.


That collection company will begin to credit report on you that you owe an old balance that you've already paid off. This violates the fair debt collection practices Act. Also once this issue is properly disputed, will also violate the Fair Credit Reporting Act.


And these times cases what you want to do is make sure to get the original documents or copies of those documents to show that you actually paid off the loan. You may even want to get a screenshot of the proof that you made the payment. You can get that through your online bank.
