Sneiderman’s Attorney & Alleged DUI on Buford Highway

Attorney Jennifer Little, recently hired by the widow of Dunwoody day care shooting victim Rusty Sneiderman, was arrested early Thursday morning and charged with suspected DUI, speeding and reckless driving according to the Atlanta Journal Constitution.

Little driving on I-85 near Buford Highway around 12:30 a.m. when she was allegedly stopped by the Atlanta police, who clocked her at 91 mph.  The speed limit is 55.  This upsets me.  Her allegedly drinking  bothers me, but the speed gets me more.  At that speed she knew she was doing wrong.  She likely knew she had been drinking (if she was).  So, she put herself in this position.

The former DeKalb County prosecutor, the attorney that is the chief legal representative in the prosecution of crimes within a jurisdiction, refused field and chemical sobriety tests, according to a representative from that Atlanta Police Department, that got Mrs. Little a charge of DUI Less Safe. She likely charged hundreds if not thousands of people with that charge.  I am sure she knows the elements of that crime quite well.  DUI Less Safe means that the blood alcohol level is less of concern, but rather the ability of the driver to handle the amount of alcohol consumed.  This means that if you had one drink, but it made you a terrible driver, you can be charged regardless if the blood alcohol level was below 0.08 as required under Georgia law..

Little, 33, and law partner Doug Chalmers were hired by Andrea Sneiderman in during the trial of her former boss, Hemy Neuman, who was sentenced to life in prison for killing the Dunwoody woman’s husband.

Sneiderman may soon face criminal charges herself. A DeKalb County grand jury has subpoenaed Channel 2 Action News for the entirety of her testimony given during the Neuman trial. DeKalb D.A. Robert James told the Atlanta Journal-Constitution he believes Sneiderman was involved in her husband’s death.

Little is somewhat famous for a local attorney.  She was the former president of the DeKalb Bar Association.  If she were the current president, she likely would have stepped down or be asked to resign.  That seems like what would normally happen.  The Bar Association wants to be associated with law abiding persons, not attorneys with pending legal issues.  Remember, until she is proven guilty, she is innocent.  This is not the Trayvon Martin case where we make prediction via cable TV.

The Georgia Bar Association generally does not get involved with attorneys for minor legal problems such as misdemeanors.  The situation may change if several misdemeanors result from something or that same misdemeanor over and over.   A DUI is normally just a misdemeanor, after all.

DRIVING UNDER THE INFLUENCE

1.1 ELEMENTS OF THE CRIME
1.11 The Code provide s six (6) ways in which someone can be convic ted of DUI. The
sixth condition has been declared unconstitutional vis a vis marijuana. The six variants a re — Being in actual physical control of any moving vehicle while :
A. Under the influence of alcohol to the extent that it is less safe for the person to drive
• no need to commit less safe a ct [Susman v. Sta te , 256 App. 94, 567
SE2d 736 (2002)];
B. Unde r the influence of any drug to the extent that it is less safe for the person to drive OCGA § 40-6-391 (b) -
• driving under influence of prescription drugs – standard for conviction,
name ly: “ incapable of driving safely” is the same as “under the influence of alcohol to the extent that it is less safe for the person to
drive” [State v. Kachwalla, 274 Ga. 886, 561 SE2d 403 (2002)];

• Court need not charge jury “incapable of driving safely” language in a “less safe”case [State v. Johnson, 268 App. 426, 602 SE2d 177 (2004)];
C. Under the intentional influence of any glue , aerosol, or other toxic vapor to the extent that it is less safe for the person to drive ;
D. Under the combined influence of any two or more of the substances specified in paragraphs (1) through (3) of this subsection to the extent that it is less safe for the person to drive ;
E. Per se violations:
1. The person’s alcohol concentration is 0.08 grams or more at any time within three hours after such driving or being in actual physical control from alcohol con

2. For commercial vehicles, the amount of alcohol present in the blood, breath, or urine for which a defendant can be convicted is 0.04 grams
[OCGA § 40-6-391 (i)];
3. For persons under the age of 21, the amount of alcohol present in the blood, breath, or urine for which a defendant can be convicted is 0.02 grams [OCGA § 40-6-391 (k)]; OR
F. Subject to the provisions of subsection (b) of OCGA § 40-6-391, the re is any amount of marijuana or a controlled substance, as defined in OCGA § 16-13-21, present in the person’s blood or urine ; or both, including the metabolites and derivatives of each or both without regard to whether or not any alcohol is present in the person’s breath or blood. OCGA § 40-6-391(a). f the
defendant is being charged with paragraph (5) or paragraph (6) of subsection (a ), determining whether the person is a less safe driver is irrelevant [Stevenson v. State, 264 Ga. 892, 453 SE2d 18 (1995)].
